I represented a woman who is charged with a third DUI with a mandatory 180 days in jail, a fourth DUI with a mandatory 180 days in jail, a fifth DUI with a mandatory 180 days in jail, A 4th° driving on a suspended license under 2C:40-26 with a mandatory 180 days in county jail, and A second 4th° driving on a suspended license under 2c:40-26 with a mandatory 180 days in county jail

On paper, she would be required to serve 2 1/2 years on jail.

She received three concurrent 90 Day sentences on the DUIs, for a total of 90 days in jail. The state of New Jersey will pay for her inpatient alcohol treatment after the jail. She avoided any jail for the driving on the suspended licenses, in spite of the requirement for 180 days.

DWI Case Result – Refusal Dismissed

DWI: Defendant hit and knocked over a street light in one town. He was driving in another town with the damaged car and missing headlight. The police stopped him and he admitted drinking long island ice teas. He refused to take a breathalyzer test. He has a prior DWI. He received a DWI, Refusal, and 9 tickets from the one city and 7 tickets from the other city. … We filed a motion to have the Assignment Judge in charge of the county order the two cases into one court. The prior DWI was not used to enhance his sentence. The prosecutor dismissed the refusal ticket. The defendant wound up with the lowest possible suspension of 3 months and all the other tickets were dismissed.
